Legality of Delta-8 THC


It may come as a surprise, but more than one type of THC exists. Currently, the two most prominent types of THC are Delta-8 THC and Delta-9 THC. When people talk about “weed” or “marijuana,” they are generally talking about forms of cannabis that contain Delta-9 THC. Delta-8 THC (i.e., Cloud 8) is different.


Most importantly, Delta-8 THC was legalized under the Agriculture Improvement Act of 2018 (commonly referred to as the “2018 Farm Bill”). Specifically, the 2018 Farm Bill removed from the federal schedules of controlled substances all cannabis derivatives, extracts, isomers, and cannabinoids (e.g., Delta-8 THC and CBD) that contain no more than 0.3% Delta-9 THC, and these products are legally classified as "hemp.” It is also important to note that the 2018 Farm Bill amended the Controlled Substances Act to explicitly remove all tetrahydrocannabinols found in hemp, such as Delta-8 THC.
